Online Platforms

In April 2018, the European Commission released the Draft Regulation on promoting fairness and transparency for business users of online intermediation services (“platforms”).

EACA welcomes the Commission’s determination to increase the transparency and fairness around platforms. However, EACA is disappointed at the Commission’s lack of ambition regarding the scope of the planned legislation. Under the proposal, only a very narrowly defined set of business users would be able to benefit from increased transparency and fairness. Unfortunately, this position is also sustained in both the European Parliament and the Council. Advertising and media agencies that work closely with these intermediation service providers will therefore not benefit from increased bargaining powers vis-à-vis platforms when it comes to ensuring fair, transparent and balanced trading practices and allowing data given by providers of online intermediation services to be verified.

EACA considers the narrow scope a missed opportunity given the momentum that the draft proposal has created. Pending any future changes, EACA has been invited to join the Observatory on the Online Platform Economy as an observer and will continue raising awareness of the problems that the advertising agencies face.
